CALIFORNIA PRODUCTS

The nation's disclosure industry was launched over 30 years ago in California when the first hazard zone disclosure report was issued by FANHD (through its subsidiary, JCP). It responded to a real estate disclosure law passed by the State legislature after the 1971 San Fernando earthquake disaster. Since then, after each major disaster, the State's consumer protection laws have multiplied and so have FANHD's disclosure products. Our current line-up is below.

NATURAL HAZARDS - Covers Federal, State, and Local City and County-level natural hazard disclosures, including the state-mandated earthquake, fire and flood zones on the statutory "Natural Hazard Disclosure Statement". Also addresses Former Military Ordnance Sites, Airport Influence Areas, Commercial & Industrial Usage, Megan’s Law, Toxic Mold Act, Radon, and additional disclosures.
 
PROPERTY TAX LIABILITY - Includes the state-mandated "Notice of Special Tax" (for Mello Roos Community Facilities Districts) and "Notice of Special Assessment" (1915 Bond Act) and a detailed breakdown of all local taxes to help you fully satisfy statutory requirements and standard-of-care. The C.L.U.E.® Risk-Only ReportTM - $19.00
Five-year history of insurance claims on the property
 
The C.L.U.E.® Risk Only Report is the real estate industry's preferred source of information about insurance claims history. It reveals claims made during the past five years on the subject property only. This is a "risk-only" report, meaning that it discloses claims made on the property only, without revealing private information about the current or previous owners. The report covers claims for loss types including fire, flood, earthquake, and burglary. This report is available only for residential property.
 
If purchased early in the escrow period, the C.L.U.E.® Risk Only Report can identify insurability issues in sufficient time to resolve them before closing. (Available nationally.)

ARIZONA PRODUCTS

Increasingly, other states are following California's lead in regulating seller disclosures in real property transactions. In 2006 and 2007 the State of Arizona enacted laws that authorize the use of third-party disclosure reports in real estate transactions. While not mandating written disclosure reports, the laws define the types of hazards that must be addressed in them.
 
FANHD's disclosure product below assists Arizona homebuyers in the "due-diligence" investigation of their property before signing the purchase contract, and protects sellers by disclosing up front the hazards which the State considers important in a property transaction -- all in a clear and simple report format.
 


 
The Arizona Property Hazard Disclosure ReportTM - $89.95
Satisfies Arizona requirements for third-party disclosure reports
 
NATURAL HAZARDS - Covers FEMA Special flood hazards, mapped expansive soil zones, mapped earth fissures, and radon gas potential zones.
 
PROPERTY TAX LIABILITY - Reports special tax assessment areas, or taxing authority and amount of special assessments, in addition to ad valorem taxes, as shown in the current tax records of the applicable county assessor.
 
LIMITED ENVIRONMENTAL SCREENING - Lists environmental hazard "superfund" sites including the sites listed in the Arizona Superfund Program List and the Water Quality Assurance Revolving Fund Registry or listed by the United States Environmental Protection Agency including the National Priorities List (NPL), the Comprehensive Environmental Response Compensation and Liability Information System (CERCLIS) database, or on maps issued by the Arizona Department of Environmental Quality or equivalent databases of those sites. NOTE: Arizona law limits this environmental screening section to only the "worst of the worst" contaminated sites.

Most of the new homebuyers, and many of the new agents, there are California transplants whose expectations about the homebuying process are based on the Golden State's consumer-friendly disclosure environment. In response, the Greater Las Vegas Association of Realtors has become a national leader in promoting risk-reduction by its member agents and brokers. FANHD's disclosure products for Nevada are designed to assist sellers and their agents in minimizing the potential for non-disclosure lawsuits after the transaction has closed.

This is required under the Federal "Fair Credit Reporting Act" to protect the privacy of consumer information. The report covers claims for loss types including fire, flood, earthquake, and burglary. This report is available only for residential property.
